Welcome to Mink Digital Design. These Terms of Service govern your use of our website and the design and creative services provided by Mink Digital Design. By using this website, requesting a quote, placing an order, making a payment, or engaging us for a project, you agree to these Terms.
1. Our Services
Mink Digital Design provides creative and digital services including logo design, brand identity design, graphic design, website design and development, website redesign, marketing materials, and other custom design services.
The exact scope, deliverables, timeline, and pricing for each project will be communicated through the applicable service package, quotation, proposal, invoice, or written agreement.
2. Quotes & Project Scope
Custom quotes are based on the information provided by the client and are valid for the period specified in the quotation, if applicable.
Work requested outside the agreed project scope may require additional fees and may affect the estimated completion timeline. We will communicate any significant additional charges before proceeding with out-of-scope work.
3. Payments
Payment requirements may vary depending on the type and scope of the project. Payment terms will be communicated before work begins.
Projects may require full payment or a deposit before work starts, with any remaining balance payable according to the agreed payment schedule.
Payments may be processed securely through third-party payment providers. Mink Digital Design does not directly store complete payment card information.
4. Project Information & Client Responsibilities
Clients are responsible for providing accurate information and all materials reasonably required to complete their project, including text, images, logos, brand assets, account access, approvals, and other relevant content.
The client confirms that they have the necessary rights or permissions to use any materials they provide to us.
Delays in providing content, feedback, approvals, or access may affect the project timeline.
5. Revisions
The number of revisions included in a project depends on the selected service or agreed project scope.
Revision requests should relate to the original project brief. Significant changes in direction, additional concepts, new pages, additional functionality, or work outside the agreed scope may be quoted separately.
6. Project Timelines
Any completion dates or project timelines provided are estimates unless specifically agreed otherwise in writing.
Timelines may change due to the complexity of the project, delayed client feedback, additional requests, third-party services, technical issues, or circumstances outside our reasonable control.
We will make reasonable efforts to communicate significant changes to an estimated timeline.
7. Website Projects
Website projects may involve third-party platforms, themes, plugins, hosting providers, domain registrars, APIs, fonts, images, or other external services.
Unless specifically included in your quotation or package, costs associated with domains, hosting, premium plugins, third-party software, subscriptions, licenses, or external services are the client’s responsibility.
We cannot guarantee the continuous availability, performance, compatibility, or future operation of third-party products or services.
8. Intellectual Property
Clients retain ownership of content and materials they provide to Mink Digital Design.
Unless otherwise agreed, ownership of the approved final custom design deliverables transfers to the client after all applicable project payments have been received.
Unused concepts, preliminary designs, drafts, working files, design methods, and materials not included as final deliverables remain the property of Mink Digital Design unless otherwise agreed in writing.
Third-party assets remain subject to their respective licenses and ownership terms.
9. Portfolio Use
Unless confidentiality has been agreed in writing, Mink Digital Design may display completed work for promotional and portfolio purposes, including on our website, social media, presentations, and other marketing channels.
If your project requires confidentiality, please discuss this with us before the project begins.
10. Cancellations & Refunds
Cancellation and refund eligibility depends on the project status, work already completed, and the type of service purchased.
Because design and website services involve time and custom work, payments may become partially or fully non-refundable once work has begun.
Where applicable, refund requests will be handled according to our published Refund Policy and the terms agreed for the individual project.

11. Project Inactivity
If a project becomes inactive because required content, feedback, approvals, or communication has not been received from the client for an extended period, the project may be placed on hold.
Resuming an inactive project may be subject to scheduling availability and, where significant additional work is required, additional charges.
12. Accuracy & Approval
Clients are responsible for reviewing final designs, website content, spelling, contact information, pricing, legal information, and other materials before final approval or publication.
Once a client approves a deliverable, Mink Digital Design is not responsible for errors that were present in the approved version unless otherwise agreed.
13. No Guarantee of Business Results
We aim to create professional design and digital solutions that support our clients’ business goals. However, we cannot guarantee specific commercial outcomes such as increased sales, leads, website traffic, search rankings, revenue, or business growth unless expressly agreed otherwise in writing.
Results can depend on many factors outside the design work itself.
14. Third-Party Services
Our website or client projects may use or link to third-party services.
Mink Digital Design is not responsible for the policies, availability, security, pricing, performance, or actions of independent third-party providers. Your use of those services may also be subject to their own terms and policies.
15. Limitation of Liability
To the extent permitted by applicable law, Mink Digital Design will not be liable for indirect, incidental, special, or consequential losses arising from the use of our website or services.
Where liability cannot legally be excluded, our liability will be limited to the extent permitted by applicable law.
Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.
16. Acceptable Use
You agree not to misuse this website, attempt unauthorized access, interfere with its operation, distribute malicious software, or use our services for unlawful or fraudulent purposes.
We reserve the right to refuse or discontinue services where a project involves unlawful, abusive, fraudulent, or otherwise inappropriate activity.
